Crucial details emerged yesterday (11) before the Colombo Permanent High Court Trial-at-Bar in the high-profile case filed against former Health Minister Keheliya Rambukwella and others. The case concerns the importation of substandard Human Intravenous Immunoglobulin (IVIG), an act alleged to have endangered patient lives and defrauded the state of billions in funds.
Testimonies and documentary evidence submitted to the court suggest that this fraud was not merely the result of a frantic emergency purchase, but a calculated effort by high-ranking administrative and executive officials to dismantle the established protocols of the National Medicines Regulatory Authority (NMRA).
The “Special Fast-Track Mechanism” Revealed in Court
Giving evidence yesterday (11), NMRA Evaluation Officer Nishani Lanka Karunathilaka revealed the existence of a “Special Fast-Track Mechanism” designed specifically to procure medicines from unregistered suppliers, bypassing standard legal procedures.
It was disclosed that the then NMRA Chairman (12th Accused) had requested approval for this mechanism from the then Health Secretary (6th Accused). Alarmingly, the request sought a “blanket approval” without specifying the name of the supplier or the institution from which the medicines were to be imported, effectively opening the door for unregulated entities.
Shadows of the Presidential Secretariat and the Health Secretary’s Influence
While the “Fast-Track” method was being debated in open court, parallel state documents (Documentary Evidence) have surfaced, exposing the high-level political and bureaucratic patronage extended to this process, particularly concerning the local entity ‘Isolez Biotech Pharma AG Ltd’.
According to the relevant documents:
1. Intervention by the Presidential Secretariat: A GMP (Good Manufacturing Practice) inspection of a pharmaceutical manufacturing plant is strictly a technical and scientific process handled by pharmacists and analysts. However, documents reveal that Mr. Srinath Gamage, a Director at the Presidential Secretariat, participated as an “Observer” in the crucial stakeholder meeting on January 26, 2023, and the subsequent factory inspection in February 2023. The presence of a representative from the highest executive office in a technical scientific audit raises serious questions regarding an “invisible hand” steering the project.
2. Resurrection by the Health Secretary: The NMRA had previously rejected this specific company as unsuitable in August 2022. Despite this prior rejection, following a meeting at the Health Ministry on January 17, 2023, the Health Secretary (6th Accused) issued a directive requesting the NMRA to re-engage with the company and assess its potential again.
Technical Officers Stand Firm
Despite this high-level pressure from the Executive and the Ministry, the NMRA inspection panel appears to have maintained their technical integrity. The final report issued on April 18, 2023, under the signature of the NMRA CEO, conclusively stated that the company was “not suitable for manufacturing sterile injections.”
Legal Analysis: Emergency or Conspiracy?
The defense has consistently argued before the High Court that these decisions were driven by the country’s economic “crisis” at the time. However, the analysis of evidence—specifically the direct involvement of the Presidential Secretariat and the Health Secretary’s push for rejected suppliers under a nameless “fast-track” approval—strengthens the prosecution’s argument.
Legal experts suggest these elements point not to a chaotic emergency response, but to a systematic “State Mechanism Manipulation” that likely could not have occurred without the blessing of the political authority.

එම ඉල්ලීම කළ එවකට ඖෂධ නියාමන අධිකාරියේ සභාපතිවරයා ලෙස කටයුතු කළ 12 වන විත්තිකාර වෛද්ය විජිත් ගුණසේකර මහතා මෙන්ම එවකට සෞඛ්ය අමාත්යාංශයේ ලේකම්වරයා ලෙස කටයුතු කළ හයවන විත්තිකාර ජනක ශ්රී චන්ද්රගුප්ත මහතාද අධිකරණයේ විත්ති කූඩුවේ සිටින්නේ යයිද එම සාක්ෂිකාරිය දෙවන දිනටත් පැමිණිල්ල වෙනුවෙන් සාක්ෂි දෙමින් පැවසුවාය.

දින දෙකක් පුරා පැවති එම සාක්ෂිකාරියගේ මූලික සාක්ෂි විමසීම තෙවන දිනටත් අද (12) දක්වා කල්තැබීමට විනිසුරු මඩුල්ල නියෝග කළේය.
